Our Policies

Things happen. We will work with you to the best of our ability to reschedule and in some cases refund as well. Please read our policies closely, as they provide important information you need to know. You can always call with any questions or concerns.

Cancellation Policies

Guided Diving and Discover Scientific Diving

  • There is no penalty for Guided Diving or Discover Scientific Diving cancellations received 7 days prior to your activity. We will refund or reschedule your visit at no charge.
  • We offer a 50% refund for bookings cancelled between 7 days and 72 hours prior to your scheduled arrival. If you choose to reschedule instead of cancel, you may be charged a rebooking fee.
  • No refunds will be made for cancellations within 72 hours of your scheduled arrival unless all transportation to the island is cancelled by the carriers due to weather conditions.

Discover Scuba Diving

  • There is no penalty for Discover Scuba Diving cancellations received 7 days prior to your activity. We will refund or reschedule your visit at no charge.
  • We offer a 50% refund for bookings cancelled between 7 days and 72 hours prior to your scheduled arrival. If you choose to reschedule instead of cancel, you may be charged a rebooking fee.
  • No refunds will be made for cancellations within 72 hours of your scheduled arrival unless all transportation to the island is cancelled by the carriers due to weather conditions
  • No refunds will be given if a diver is disqualified on site for medical reasons which were not disclosed and discussed at the time of booking.
  • If you have reserved a videographer for a dive and the booking has been confirmed with the videographer, no refund will be given for that cost if you choose to cancel within 72 hours.

Pro-rating Policy – Guided Diving, Discover Scientific Diving and Discover Scuba Diving

As Guided Diving, Discover Scientific Diving and Discover Scuba Diving are booked in 1/2 or full day increments, no pro-rating is available.

This includes:

  • Late customer arrival (including missing the ferry or helicopter) or time management issues (such as taking lengthy surface intervals) which do not leave enough time for all dives planned in the time slot.
  • Incorrect information regarding sizing and/ or equipment needed. Because we bring your gear to you, we would need to leave Casino Point to exchange sizes or retrieve necessary items. This may not leave enough time for all dives planned in the time slot.
  • Inability to complete a dive for any reason (such as unable to equalize, unable to maintain buoyancy, tired, cold, or any other issue).

Certification Classes

  • Payment for a class does not guarantee certification. Payment is for the class, but a certification must be earned. Therefore, no refunds will be given for classes where no certification is earned.
  • Certification class cancellations received 7 days prior to the start date will be rescheduled at no charge. If we have issued e-Learning and you wish to cancel the class, the cost of the e-Learning is non-refundable regardless of the timeframe of the cancellation. E-learning cost is different for each certification.
  • We offer a 50% refund for bookings cancelled between 7 days and 72 hours prior to your scheduled arrival, minus the cost of e-Learning. If you choose to reschedule instead of cancel, you may be charged a rebooking fee.
  • No refunds will be made for cancellations within 72 hours of your scheduled arrival unless all transportation to the island is cancelled by the carriers due to weather conditions.

Pro-rating Policy – Certification Classes

As Certification Classes are booked in partial, single or multi-day time increments, no pro-rating is available.

This includes:

  • Late customer arrival (including missing the ferry or helicopter) or time management issues (such as taking lengthy surface intervals) which do not leave enough time for all dives planned per day.
  • Incorrect information regarding sizing and/ or equipment needed. Because we bring your gear to you, we would need to leave Casino Point to exchange sizes or retrieve necessary items. This may not leave enough time for all dives planned per day.
  • Completion of required dives in less time than booked.
  • Inability to complete a dive or certification class. Additional days can be booked to complete the class, or Referral paperwork can be issued.

Adaptive Diving Cancellations

  • All the above standard Cancellation Policy conditions apply, however unique considerations may entitle you to a refund.  Please discuss any concerns with us before booking.
  • You will be asked to agree to individual cancellation terms and conditions.

Catering Cancellations

If you have ordered catered food and/ or beverage delivery, we will attempt to cancel your reservation with the vendor.  Refunds will be issued at their discretion and may include a cancellation fee.

Cancellations by Scuba by Design

  • If weather conditions are unsafe for diving or other unforeseen issues occur, we will refund or reschedule your visit at no charge. This is particularly true for Discover Scuba Diving experiences and Confined Water portions of Certification Classes as PADI standards require pool-like conditions.
  • No refund will be given, and dives will be cancelled and recorded as a No-Show if:
    • required medical paperwork or parental consent forms are missing
    • no certification card/ e-card is provided on site, and we are unable to verify by other means
    • certification requirements for any dive or class are not met
    • a language barrier exists, and we are unable to communicate in English (unless a certified translator who can convey technical information is on site – not family or friends).
    • arrival is more than 1 hour late for any reason without notification, including missing the ferry or helicopter
    • a diver appears to be under the influence of alcohol or any other controlled substance
    • a customer does not like the weather (too cold, warm, or wavy) and we believe it to be safe to dive
    • your instructor believes that medical, safety or liability issues preclude diving for the day

Please call us to discuss any changes to your booking. All reservation change or cancellation requests must be submitted in writing by email. Please reply to your original booking confirmation email.

 

Privacy Policy

Personal Information Collected

When we talk about “Personal Information” in this Privacy Policy, we are talking both about Device Information and Personal Information you have given us and visual imagery.

We collect Personal Information from you through online forms, emails we send that you read and click, forms and applications that you submit to us, photos taken during your time with us and the pages you visit on our website after clicking emails or completing online forms. This information may include:

  • Email Address
  • Name
  • Address
  • Company
  • Location Data
  • Photos

We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our viewers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns). We use analytics to gather usage information about our website and communications. This helps us understand their effectiveness.

Data you provide with consent is held until you withdraw that consent. Data about how you engage with us, such as reading emails and browsing web pages may be held for up to ten years or more from the last time you engage with us.

How Your Personal Information Is Used

  • Submitting certification information to PADI or DAN
  • Verifying certifications and insurance coverage
  • Mailing items you purchase
  • Providing medical information to Emergency Medical Services personnel in the event of a diving emergency
  • Providing and personalizing our services and website
  • Responding to your inquiries and requests
  • Administering orders and accounts
  • Providing you with information about news and events
  • Understanding what is of interest to you to improve and provide the most relevant content
  • When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services
  • Finally, we may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.

Sharing

We do not sell or distribute your information to others for the purpose of marketing to you. We may share your identifying information with third parties to help us use your Personal Information, as described above. For example, we use Google Analytics to help us understand how our customers use the Site and we work with PADI and DAN to process certifications.

Legal Basis

We use consent and legitimate interest as the GDPR basis to store and process your data. The lawful bases are (a) the performance of a contract with you and (b) it is necessary for our legitimate interests (to study how customers use our products and services, to develop them and grow our business). Legitimate interests include:

  • Responding to inquiries you make whether by phone, email, contact form, or other method.
  • Tailoring information based on your activity, such as what content you show interest in.
  • Delivering electronic information that you have requested, such as our newsletter.

Consent

By using our site, diving with us, taking photos with us, purchasing goods from us and/or subscribing to our email list, you consent to this Privacy Policy. If at any point you would like to opt out or withdraw your previously given consent please contact us using the details at this end of this policy. All our marketing emails contain unsubscribe links.

Disclosures

We will not sell, barter or rent your data. We may use third party suppliers to help us process your data but only for the purposes identified in this policy. Our website and communications may include links to third parties. We are not responsible for the privacy policies and practices of any third party to whom we link.

Your Rights

Your rights include:

  • Request the personal data we hold about you
  • Complain to a supervisory authority if you believe we have misused your data
  • Withdraw consent at any time
  • International information transfers
  • We use trusted companies to process data outside in the United States. We keep shared data to the minimum necessary, review the privacy policies of those companies and only work with companies we trust to keep your data safe.
